Referral Program Rules

These Rules govern the Xtarly referral program, operated by the same responsible party identified in our Terms and Conditions, and supplement those Terms and our Privacy Policy. By activating your code you accept these Rules as published on this page at that time.

1. What this is

A program that lets registered Xtarly users obtain a personal referral code. Businesses that create their account using that code are linked to the account of the person who shared it, solely for registration and tracking purposes. This program is separate from any other invitation or rewards program Xtarly offers inside its applications: taking part in one does not entitle you to the benefits of the other.

2. No compensation

Taking part does not entitle you to any payment, commission, discount, rebate or consideration of any kind, in cash or in kind. If Xtarly offers any benefit tied to this program in the future, it will be communicated in writing and will apply going forward only.

3. No employment or partnership

This program does not create any employment, subordination, association, partnership, franchise or agency relationship between Xtarly and the code holder. Each party is responsible for its own tax and social security obligations.

4. Attribution

A business is attributed to a code once, when the business account is created, and that attribution is final. Businesses already registered are not reassigned. Xtarly may correct or void an attribution where it detects an error or use contrary to these Rules.

5. Self-referral

You may not use your own code to register businesses you own, that belong to relatives, or in which you take part or that you manage; such registrations are not attributed. Creating duplicate accounts or registering a business without its owner's knowledge is likewise not allowed.

6. How you present yourself

The code holder acts as an independent user or consultant. You may not present yourself as an employee, representative, authorized distributor, franchisee, business partner or certified consultant of Xtarly, nor act, quote, contract or collect payment on Xtarly's behalf.

7. What you may say

You may use only the information published by Xtarly on xtarly.com and the materials Xtarly provides. You may not: offer discounts, free months, special prices or terms other than those published; promise results, sales-increase percentages or guarantees; promise features, implementation times or support that are not published; or make statements about tax or invoicing treatment.

Prices are those published and depend on the country of the business: businesses in Mexico are charged in Mexican pesos and businesses outside Mexico in US dollars. The exact amount and any applicable taxes are shown before the purchase is confirmed.

8. How you may share it

Share your code with businesses you already have a relationship with or that ask you for it. The following are prohibited: sending unsolicited communications (spam) through any channel; using Xtarly's WhatsApp number, message templates, accounts, channels or contact lists; and buying advertising on the "Xtarly" brand or similar terms.

9. Brand

These Rules grant no license over Xtarly's brand, logo or materials beyond stating that you use or implement Xtarly. You may not register trademarks, domains, email accounts or social media profiles containing "Xtarly" or similar names, nor modify the logo. Any label or badge Xtarly assigns within the platform is for internal use and grants no representation, certification or brand license.

10. Accounts and data

Each business creates its own account and accepts the terms itself: never register a business on its behalf and never use its passwords. A code holder's access to a business's dashboard is only through an invitation issued by that business from its own account, is limited to what the business instructs, and ends when the business revokes it. Extracting, copying or reusing a business's customer data for your own or third-party purposes, and contacting those customers through Xtarly's channels, are prohibited.

On the referrals screen, the code holder can see the referred business's name, its registration date and the general status of its account. Referred businesses are informed of this when they register with a code.

11. The code holder's data

To evidence your acceptance, Xtarly stores the version of these Rules you accepted, the date and time, your IP address and the browser you used. This data is processed under the Privacy Policy, for the purpose of evidencing your acceptance and preventing misuse, and is retained for as long as the code exists and for the additional period stated in that Policy.

12. Suspension and opt-out

Xtarly may suspend or deactivate a code for breach of these Rules, without affecting the accounts or plans of businesses already registered. The code holder may deactivate their code at any time from their account or by writing to atencion@xtarly.com.

13. Changes and termination

Xtarly may amend these Rules or end the program at any time, with notice through the platform. Changes apply going forward. If a new version imposes additional obligations, you will be asked to accept it in order to keep using your code. The current version and its date appear at the top of this page; previous versions are retained and may be requested at atencion@xtarly.com.

14. Governing law

These Rules are governed by Mexican law. The governing law and jurisdiction provisions of the Terms and Conditions apply to their interpretation and enforcement.
